These terms and conditions of service and promotion must be read, accepted and agreed to by the client before any work can be started and when submitting your campaign form you agree for all work to be carried out by The Pit London. These terms and conditions may be updated on a regular basis to improve customer service. The set of terms that are valid at the time of agreeing to these terms and by submitting your campaign form apply to your campaign.

Service Description
The Pit London is a music promotion company, record label, digital marketing company and online digital publisher who distribute, promote and supply music releases to Radio, Online Press, Music websites, YouTube and general worldwide media including within their own brands, managed 3rd party digital Radio and online networks and media activities.

Distribution
Distribution, if agreed, will be worldwide covering all territories and is non-exclusive.

Client Coverage
3rd party media outlets who receive promotional items from The Pit London cannot in anyway guarantee any “specific” Radio playlists/airplay, Interviews or Press coverage.  The Pit London within its own media activities and brands reserve the right to refuse any material supplied and will make the final decision as to what they play, write about or feature on their shows, stations, websites and media outlets.

Radio Interviews
As part of some services we may setup a live Radio interview schedule and this will be supplied to the client in advance of all interviews. It is crucial that all artists attend and do these interviews at the exact time allocated by the company or any 3rd party suppliers. If a client misses an interview they have agreed to, The Pit London and the 3rd party station or channel reserves the right to cancel all future interviews. If a client misses an interview or does not act in a professional manner during the interview this works against the reputation of The Pit London, it’s suppliers and the reliability of its clients and can affect other clients as well as the company’s reputation. The Pit London cannot be held responsible and will not be liable to issue any refunds for lack of service or cancellations due to any no shows on the clients’ behalf.

Refunds
The Pit London cannot in any capacity refund any monies paid to them for any services. Our standard promotion period is 3-4 weeks but this can vary in duration depending on your budget or if both parties have agreed to a different time length, however all promotions will expire and be null and void after 1 year and are not subject to limitation unless otherwise agreed with the client. If a client’s product is not delivered within this period they will be given a 14 day final notice from The Pit London. If this notice period expires and the client has still not delivered a product the service and promotion will be null and void and they will not be entitled to a refund in any capacity. If the client does not pay the full amount invoiced to them for the service they will not be entitled to a refund.

Copyright clearances
If you are an artist, individual or label submitting product to be distributed and or promoted by The Pit London, it is essential that you have copyright clearance for all tracks (both master and publishing) and artwork, and the works belong to you. The Pit London accept no responsibility for any works which do not have these clearances. By submitting our Client Campaign form and agreeing to these terms and conditions you agree that you are the 100% legal copyright owner. You agree to defend, indemnify and hold harmless The Pit London and its employees, officers, directors, shareholders, affiliates, agents, representatives, licensors, suppliers and service providers, from and against all claims, losses, costs and expenses (including attorneys fees) arising out of any violation of your copyright declaration and these Terms and Conditions by you.

Campaign Reporting
After receiving payment your campaign will be setup. The Pit London will then prepare, pitch and deliver your release to Radio and/or Media contacts and chase up on feedback. After an initial digestion period of 1 week while media accept and digest the release, reports will then begin to flow and will be delivered to you by email approximately every 5 days depending on how fast media react and the report will contain accepted coverage and feedback. We also supply rejected coverage with constructive feedback at the end of the campaign if requested by the client.

Applicable Law
Our agreement shall be governed by English and the English Courts shall have exclusive jurisdiction over any disputes. If any part of these terms and conditions are held by an appropriate authority to be unenforceable, this shall not affect the enforceability of any other part of these terms and conditions. These terms and conditions contain the whole of our agreement relating to your promotion.
